Not only is Land's opposition limp; it is also inaccurate. Sottomayor did not oversee the briefs of the lawyers for the Puerto Rican Defense Fund and so cannot be said to support (or not support) all of their arguments. Her reuling in the New Haven firefighters case was according to precedent, and the Supreme Court later enumciated a new standard (which Sottomayor could not have known when she ruled).
Land's opposition is a reflexive reflection of his unyielding, ironclad religion of biblical fundamentalism with its alloy of divinely inspired free enterprise and God-given capitalism. May Land's bastardized religion hold sway no more!
